Has Your PII (Personally Identifiable Information) Been Illegally Collected?
In a recent case, Pineda v. Williams-Sonoma Stores, Inc., the plaintiff was asked for her personal information during a credit card purchase, and believing it was necessary to complete the purchase, gave it to the cashier. The Song-Beverly Credit Card Act protects consumers from the illegal collection of their PII.
If a retailer requests any PII, such as your zip code or your phone number, in conjunction with a credit card purchase, your rights may have been violated. For the first violation, there is a $250 penalty, and for each subsequent violation, there is a $1,000 penalty. If you think your PII has been illegally collected, you may be entitled to compensation.
